On May 24, Beijing delegation of the third session of the 13th National People's Congress held a meeting, making requests for the study and implementation of the important speeches made by General Secretary Xi Jinping during 2020 Two Sessions, continuing to review the planning and budget reports, and deliberating on the draft of civil law. Cai Qi, Secretary of the CPC Municipal Committee, Mayor Chen Jining, Deputy Secretary of the CPC Municipal Committee, Li Wei, Director of the Standing Committee of the Municipal People's Congress attended the meeting.
In the morning, the representatives carefully reviewed the plan report and the budget report, made a series of proposals. Representative Jin Wei said that the plan and budget report were in the same line with the government work report. The objectives and tasks for the next phase of work had been defined. The government should promptly improve the mechanism to adapt to the normal epidemic prevention and control, accelerate the transformation of the digital government, promote the construction of a digital city, build a digital society, and lead the digital life. We should strengthen our overall thinking, break down data barriers, speed up the optimization and cross-departmental business processes, and promote the seamless and timely flow of government data resources. We should strengthen the application thinking, improve the service efficiency, use the block chain technology to collect and share, use all kinds of data, effectively connect all kinds of subjects, build a linkage interactive data system, reinforce the construction of application scenarios, and use innovative results to support the needs of economic and social governance. We should strengthen user thinking, improve user experience, set up the perspectives of the enterprise and the public with the goal of providing users with satisfactory public services to improve user experience, and constantly optimize the process, mode, channel and content of government affairs.
In the afternoon, when deliberating on the draft of civil code, the delegates agreed that the compilation of the civil code was conducive to upholding and improving the system of socialism with Chinese characteristics, advancing law-based governance in all respects, modernizing the country's governance system and capacity; conducive to upholding and improving the basic socialist economic system and promoting high-quality economic development; conducive to improving the people's well-being and safeguarding the fundamental interests of the overwhelming majority of the people, which fully demonstrated the achievements and confidence of the socialist legal system with Chinese characteristics.
Representative Yang Wanming said that the civil code was the basic law for the courts to follow in their civil and commercial trial and enforcement work. The draft of civil code was reasonable in system, consistent in content, strict in legal provisions and clear in value orientation, which was a good code to reflect the spirit of the times. The code had five distinctive features: firstly, it took the promotion of socialist core values as the legislative purpose and ran through the whole civil code; secondly, it provided strong institutional support for the protection of property rights; thirdly, it respected the freedom of contract and provided a legal guarantee for the business environment; fourthly, it attached great importance to the protection of personality rights and personal information. Fifthly, we had implemented the policy of coordinating epidemic prevention and control and promoting economic and social development. He suggested that adding "the agreement should be in the form of writing" after "apply to register at marriage registration office, those who didn't register may not harm the interest of a third party" in the provision of matrimonial property. It could reduce a lot of unnecessary disputes and lawsuits.
Representative Hou Zhanying said, the Civil Code, the first law named after code of laws, initiated our country code codification and legislation. It reflected the need for building the rule of law in the new era. It is of great significance for advancing the modernization of the country's governance system and capacity by means of the rule of law, and for giving better play to the role of the rule of law in ensuring its foundation, stability of expectations and long-term benefits. Among them, adding the content of voluntary felon-fighting exemption to the civil code can not only curb some bad customs in the current society, but also make our life full of warmth and kindness by means of the rule of law. It is suggested that in the relevant clauses, the scope of responsibility of the relevant responsible person should be further clarified, and the specific framework and content should be elaborated, so as to avoid buck-passing in the actual operation process.
Representative Wu Chen said, the Civil Code, the "encyclopedia of social life", covered all aspects of life and was an important cornerstone of building a socialist legal system. After the adoption of the Civil Code, it is necessary to strengthen the publicity of law popularization, integrate the civil code into the civic education system, better regulate the behavior of citizens and better practice the core socialist values. We need to start from an early age, incorporate relevant legal content of the civil code into the nine-year compulsory education curriculum, strengthen education on the rule of law among young people, enhance social awareness of the rule of law, consolidate the foundation of the socialist rule of law, and integrate the spirit of the rule of law into the blood of every citizen.
